Terms of use

The agreement between you and DNF: what DNF is and isn't, your account, listing a vehicle, offers and messages, fees, liability and changes.

These terms are an agreement between you and Magnitude Marketing & Design, an Alberta sole proprietorship ("DNF", "we"), PO BOX 99900 LR 140 231, RPO LONDON, KELOWNA BC V4T 0A3, Canada, support@damagednotfinished.com. By creating an account you agree to them.

What DNF is

DNF is an online listing and introduction service for salvage, crash-damaged, rebuilt and parts-only vehicles. We don't own, buy, sell or broker vehicles, we don't negotiate for buyers or sellers, and we never handle the money for a vehicle. A sale is between the buyer and the seller. Sellers set their own prices and decide which offers to accept.

What we don't do

We don't inspect vehicles or check listings with any registry. Everything on a listing is reported by its seller. The Score is worked out from the seller's answers and isn't a rating of the vehicle's condition or value. Staff picks in the Paddock are chosen, not inspected. Our guides sum up public rules and aren't legal advice.

Your account

You need to be 18 or older and give a real email address. Keep your password to yourself. You're responsible for what's done with your account.

Listing a vehicle

You can list a vehicle only if you own it or have the authority to sell it. What you enter must be true to the best of your knowledge, including its status brand, damage, condition and any money owed on it. You'll give the buyer the documents your province or state requires.

In Canada, we list every vehicle with flood or fire damage for parts only, whatever its brand. In the United States, a vehicle with a flood or fire brand is listed with its state's brand and a high-risk notice instead. Virginia doesn't allow a vehicle titled "Junk Nonnegotiable - Not for Resale" to be sold, so it can't be listed.

Moderators can review, send back or remove any listing, and we can suspend accounts that break these terms.

Offers and messages

No dealer licence is needed to make an offer. A few US states limit who can buy certain salvage or nonrepairable vehicles, and those listings say so. On such a listing titled in Illinois, Michigan or Virginia, only buyers the state allows, such as licensed recyclers, can make an offer, and they add their licence number to a business profile first.

An offer is an offer to buy at that price, and accepting it means you both agree to go ahead. Once a seller accepts and any required platform fees on both sides are paid, we share each side's contact details. You arrange the viewing, the paperwork and the pickup yourselves, and pay the vehicle price directly to the seller. Check the vehicle, its registration and any liens before you pay. Don't use DNF to send spam, to harass anyone or to arrange a sale that breaks the law.

Fees

Listing a vehicle and making offers are free. When fees apply, the seller pays a success fee and the buyer pays an introduction fee after an offer is accepted. We collect these platform fees separately through Stripe; we never collect the vehicle price. We'll show your full fee, including any tax, and the refund terms before you commit, and include them in your receipt. Contact details stay hidden until both sides' required fees are paid.

If a sale falls through, the seller should choose "The deal fell through" on the accepted offer. The seller's paid success fee is refunded. The buyer's paid introduction fee is refunded if contact details were never released. Once the introduction has happened, the buyer's fee is normally retained; contact support@damagednotfinished.com to request a review if the failed deal wasn't the buyer's fault. Unpaid fees close when the deal ends. If a fee payment deadline passes before the introduction, unpaid fees close and any fee already paid is refunded. A listing still marked sale pending goes back on sale.

Liability

DNF is provided as is. To the extent the law allows, we aren't responsible for a vehicle, a listing, or what a buyer or seller does. Nothing in these terms limits rights you have under consumer protection law.

Changes and contact

We'll tell you by email before these terms change in a way that matters. Questions go to support@damagednotfinished.com. If you live in Canada, these terms are governed by the laws of Alberta and the federal laws of Canada that apply there, and the courts of Alberta decide any dispute about them. If you live in the United States, they are governed by the laws of the State of Nevada and the federal laws of the United States that apply there, and the state and federal courts in Nevada decide any dispute about them. Either way, you keep the protections the consumer laws of your own province or state give you.
